In its response to a wrongful shooting lawsuit filed by a man shot in Contra Costa by Vallejo officers last year, the city denied the leading plaintiff and his passenger were stationary with their hands up when the officers fired upon them. Vallejo's response , filed in federal court in late February, denies claims made by the plaintiffs' attorney in January that officers acted improperly when they shot 21-year-old Kevin DeCarlo several times in the head, fingers and ribcage.
